IMO Requests Appeal of IQC Decision on Judge Hoxha

The International Monitoring Operation (IMO) requests the appeal of the decision of the Independent Qualification Commission (IQC) that confirmed Gerd Hoxha, a judge at the Court of First Instance, Tirana.

The IQC passed him on June 3, while on July 1, the decision was notified to the Public Commissioners. This Thursday, the IMO presented the recommendation for appealing the decision to the Appeal Chamber against Hoxha.

“On 3.6.2021, at the end of the relevant hearing, the Independent Qualification Commission decided the confirmation in office of the subject of re-evaluation, Mr. Gerd Hoxha, acting judge at the Court of First Instance, Tirana.

Decision no. 393, dated 3.6.2021, of the Independent Qualification Commission, was notified to the Public Commissioners on 1.7.2021.

On 8.7.2021, the International Monitoring Operation submitted to the Public Commissioners the recommendation to appeal the decision to the Appeal Chamber.

The Public Commissioners are reviewing, at the same time, the decision of the Independent Qualification Commission and the recommendation of the International Monitoring Operation.

Based on point 1, article 63, of law no. 84/2016, "On the transitional re-evaluation of judges and prosecutors in the Republic of Albania", Public Commissioners, within 15 days from the date of notification of the decision by the Independent Qualification Commission, have the right to file an appeal with the Appeal Chamber.

The recommendation of the International Monitoring Operation is published on the official website of the Institution of Public Commissioners.

The Institution of Public Commissioners has been established and functions on the basis of Article 179 / b and the annex of the Constitution of the Republic of Albania, and law no. 84/2016, "On the transitional re-evaluation of judges and prosecutors in the Republic of Albania".
