Interference with the TIMS System, Tirana Prosecution Takes Former Official to Court

Tirana Prosecutor’s Office concluded investigations and has taken the defendant E.M., currently under house arrest, to court for the criminal offense of "Unauthorized Computer Interference," as stipulated in Article 192/b/2 of the Criminal Code.

The entire investigative actions into criminal case no. 5404, dated 01.09.2023, revealed that defendant E.M. did not inform the General Director of the State Police on the backup procedures and data extraction. He did not provide any information, memo, or action plan to address the identified issues or the steps taken to resolve them.

Defendant E.M. ordered employees to open the USB ports and carried out these actions late into the night. During this time, unauthorized individuals, specifically K.M., entered the building to assist with the backup process. K.M., not a member of the staff, often used the personal PIN of an absent employee for access.

It is also clearly confirmed that the seized hard disk is connected to the identified computer linked to the servers. This connection was established to enable the manual backup process by transferring data to the hard disk. This process was unnecessary since the system automatically performs two backups. Additionally, traces of the backup process were identified on the seized hard disk. As per above, it is confirmed that unauthorized computer access took place. After the USB ports were opened, the backup process started and continued but was not fully accomplished.

The criminal offense of “Abuse of office” as stipulated in Article 248 of the Criminal Code and registered under no.5404/2023 has been separated.
