Tirana Prosecution Office has registered the criminal proceeding No.1285 of the year 2023 (attached), concerning the criminal offense of "Illegal Construction" as stipulated in Article 199/a of the Criminal Code.
In the course of preliminary investigations, the prosecution conducted thorough investigations, including interrogations, inspections, and seizures at relevant institutions, as well as technical assessments and in conclusion the findings revealed multiple criminal offenses, including those envisaged by articles 199/a/3, 186/2, 186/3, and 300 of the Criminal Code. Specifically, within the forest economy zones 1/a and 2/a in Mullet area, 7 buildings (villas) were built. Despite being formally equipped with reconstruction permits, it was discovered that the technical and legal documentation used contained falsified information, thereby violating upon forest reserves within the jurisdiction of Tirana Municipality.
Under these circumstances, the prosecution authority has assessed that there is evidence and reasonable suspicion to proceed with the indictment, for the criminal offenses of the individuals as follows:
A. P. architect accused of the criminal offense "Falsification of documents" as stipulated in Article 186/3 and 25 of the Criminal Code;
K. B. architect accused of the criminal offense "Falsification of documents" as stipulated in Article 186/3 and 25 of the Criminal Code;
M.T. accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 and "Falsification of documents" as stipulated in Article 186/2 of the Criminal  Code;
F.Z. accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 and "Falsification of documents" as stipulated in Article 186/2 of the Criminal Code;
A.T. accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 and "Falsification of documents" as stipulated in Article 186/2 of the Criminal  Code;
M.D. accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 and "Falsification of documents" as stipulated in Article 186/2 of the Criminal  Code;
T.V. accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 and "Falsification of documents" as stipulated in Article 186/2 of the Criminal  Code;
D.D. accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 of the Criminal Code;
A.H., accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 and "Falsification of documents" as stipulated in Article 186/2 of the Criminal  Code; and
G.M., accused of the criminal offense "Illegal construction" as stipulated in Article 199/a/3 and " Failure to report a crime " as stipulated in Article 300 of the Criminal  Code.

Concurrently, in accordance with Article 274 of the Criminal Procedure Code, Tirana Prosecution Office has demanded the appropriation of the illegal objects and Tirana District Court by decision no. 3625 dated 20.11.2023 has ordered the imposition of preventive seizure on the constructed objects.
Investigations are ongoing to uncover actions and inactions of public entities as well as potential accomplices for the criminal offenses of "Falsification of documents" and "Abuse of Office" as stipulated in articles 186/3 and 248 of the Criminal  Code.
