Tirana Judge Certified in Duty by Vetting
Judge of Tirana's Court, Oltjona Goxha has passed Tuesday the vetting process, after she faced the Independent Qualification Commission (IQC) on Friday, December 23.
During the hearing, she gave brief explanations about the sources of the taxable part of a vehicle donated by his parents before the start of her job, an asset for which the IQC had passed the burden of proof due to the lack of resources of the family members.
Goxhaj opposed this finding of the IQC, while the report did not reveal any other problems in any of the revaluation criteria, that of wealth, clean image and professionalism.
Vetting process for Judge Goxha was done by the IQC body, headed by Olsi Komici, with rapporteur Xhensila Pine and member Firdes Shulin. Steven Kessler was present as an international observer.
Oltjona Goxha graduated from the Magistrate's School in 2016 and since then has been working as a judge at the Tirana Judicial District Court.
Reporter Pine clarified that the subject has been given the burden of proof to prove the possibility of the family of origin to donate a vehicle, property that he has declared that he owns jointly with his sister, with a tax share of 50% each. In the hearing, it was evident that the subject's sister was also subject to reassessment and was verified for this property.
According to Pine, although this donation was made before the subject started the task, the family members were considered as related persons and their possibility to buy the vehicle in 2011 against the amount of 980 thousand ALL was verified.
Commission has established that the family members own a commercial company, but nevertheless it has been established that the possibility of saving the amount of 980 thousand ALL has not been proven. The income of the sister and one of the brothers are also included in this financial analysis, since the other subject has stated that he did not live with the family of origin for years.
Judge Goxha opposed this conclusion of the Commission. She considered it unfair to pass the burden of proof for the entire value of the vehicle, stressing that it has been proven that she owns only 1/2 of this property. "It is the only asset I own and it was created before the start of the task," she observed and insisted that the family had resources for multiples of the value spent on the purchase of the vehicle they donated.
"They had sufficient income and profits, despite the fact that they did not distribute dividends. They had financial opportunities to create the amount of 490 thousand ALL. "During the re-evaluation process carried out against her, the sister has provided sufficient evidence that the income she received from the School of Magistrates served for her part", Goxha declared in the session.
Goxha considered it unfair to conduct the financial analysis from 2007. According to her, it was unclear why the analysis had to start in 2007, when it turned out that the family members had significant income in previous years as well.
