Tirana Prosecution Takes 'Benet Holding' and Administrator to Court for Evading 54 Million Lek in Taxes and Concealment of Income

Tirana Prosecutor’s Office concluded its investigations and took citizen Genta Perleka and the company Benet Holding Ltd. to court for the criminal offenses of ‘Concealment of income’ and ‘Failure to pay taxes and tariffs', as stipulated in articles 180/3 and 181 of the Criminal Code.

Within investigations concerning criminal case no. 5861 of 2023, it was proved that the entity mentioned above engaged in 'Business consulting and other advisory services,' along with its administrator G.P. had committed the criminal offenses of 'Failure to pay taxes and tariffs' and 'Concealment of income' for the period 2018 to 2021.
Investigations found that Benet Holding Ltd., with citizen G.P. as the administrator, avoided tax obligations by failing to submit required documents or disclose necessary information in accordance with current legislation, and by submitting forged documents or declarations, aimed at obtaining financial gain for themselves or others resulting in evading a total of 53,891,336 Lek in taxes and duties due to inaccurate tax calculations.

Tirana Prosecutor’s Office proved that the individual under investigation, G.P., conducted undeclared sales intending to evade VAT payment, as Benet Holding Ltd. did not meet the criteria set by VAT law for conducting VAT-exempt sales, etc. The Final Inspection Report provided by the Tirana Regional Tax Directorate confirmed this fact.
