Constitutional Court to Examine Beleri's Request

In Albania, the Constitutional Court has decided to accept the consideration in a plenary session of a request of the elected mayor of Himara, Fredi Beleri, for the "abolition as incompatible with the Constitution", of a series of decisions of courts of different levels, which have confirmed his detention in prison, refusing to change this security measure. 

It is about the first decision of the Special Court, the one of Appeal and the decision of the High Court. 

The examination at the session, which after the body of the members of the Court has previously evaluated the request as valid, foresees the stage where the claims are examined on the basis of the documentation. 

Mr. Beleri has tried to change the security measure against him, as he has also requested that he be given the opportunity to take the oath as the elected mayor of Himara Municipality, but these requests have always been rejected. 

He has always claimed that he is being held in prison without evidence and in violation of legal provisions, talking about decisions with a political background. 

A representative of the Union Party for Human Rights, Mr. Beleri was a candidate of the opposition coalition "Together We Win", in the local elections of May 14. He was arrested 2 days before the vote, under suspicion of vote buying. 

However, he emerged victorious, with a very narrow margin of votes with socialist rival Jorgo Goro. The investigations against him have been closed and the first sessions of the judicial process have been held. 

His arrest provoked an immediate irritation of the relations between Tirana and Athens. The latter claimed a violation of minority rights, demanding his release. A request which has already been transformed into the creation of an opportunity for Mr. Beleri to take the oath as mayor. 

Greek Prime Minister Kyriakos Mitsotakis declared a while ago when he was in Tirana to participate in the Berlin Process meeting, that he would discuss with Albanian Prime Minister Edi Rama, precisely about this. 

Greece has openly conditioned the process of Albania's rapprochement with the European Union with the Beleri case and is insisting that it does not move forward with the concrete start of membership talks. 

The decision on this step is expected for the end of this year and requires the unanimous vote of all member states.
