Tirana Prosecution Takes Two to Court for 'Abuse of Office' about the Fire at the Emergency Department

Tirana Prosecutor’s Office has concluded its investigations and brought Enea Koka and Ejnar Shena, the specialists in the clinical engineering sector at UHC Tirana, to court on charges of "Abuse of Office" under Article 248 of the Criminal Code.

The investigations into criminal proceeding no. 1578 of 2024, concerning the incident on February 29, 2024, at approximately 05:25 AM, when a fire broke out in the technical room on the second floor of the "New Emergency Department" building at "Mother Teresa" University Hospital Center in Tirana, revealed that the specialists failed to fulfill their duties as outlined in the institution’s regulations, specifically:

To ensure the safe and compliant operation of medical equipment and devices, including UPS systems and batteries, as integral components of medical devices.

To properly plan and oversee the maintenance of medical equipment and devices following manufacturers' guidelines, especially UPS systems and batteries.

To anticipate and develop a technical plan for the ventilation, airflow, and placement of UPS systems, including a fire safety design and implementation report for their designated installation site.

Administered evidence indicate that they were aware of the UPS units and batteries being installed on the second floor of the "New Emergency Department" building under improper technical conditions, failing to meet the manufacturer's required installation and functional duties to provide technical oversight and consultancy.

As part of this proceeding, a technical electrical expertise report was conducted, concluding that the fire, destroying the "New Emergency Department" at UHC, was caused by the lack of a detailed installation plan for the emergency power supply station (UPS), failure to meet technical safety requirements for its relocation and installation, and non-compliance with technical standards, fire safety regulations, and environmental conditions needed for the proper operation of the UPS system and battery rack.
