President Turns Back to Parliament Law on VAT

The President of the Republic, Ilir Meta has decided to return for reconsideration of law no. 111/2021 “On some additions and changes to law no. 92/2014 "On value added tax in the Republic of Albania", as amended ". 

According to President Meta, the differentiated fiscal treatment applied by this law, in essence, violates fundamental constitutional principles and rights. 

"For illustration, for entities operating in the field of recreational tourism, water sports, etc., has not been exempted from VAT for vessels for tourism and entertainment purposes, or the removal of the reduced rate for other activities and sectors. So these entities remain favoured through the exemption from VAT ", says the President. 

According to him, this means that these entities that operate in the sale and trade of vessels remain favoured, while specific sectors of the economy with the most need, are differentiated and kept in differentiated fiscal pressure and not proportional to the need that dictates their support. 

"Meanwhile, in the special import exemptions for machinery and equipment, the limit before these legal changes was in a value of over 50 million ALL. While with the legal changes, we have 10-fold the value of the minimum limit above which the exemption is implemented through this law. The increase of this limit, penalizes and weighs on entities that develop activity in this field. Exemptions from the implementation of the fiscal legal regime, in a differentiated way, endanger the stability of the basic law on value added tax", argues President Meta.
