Appeal Chamber Discharges Judge Gramshi

The Special Appeal Chamber announced on Thursday the decision on the case against Judge Kastriot Gramshi. The Appeal body headed by Albana Shtylla, with rapporteur Rezarta Schuetz and members Ina Rama, Sokol Çomo and Mimoza Tasi, announced that after examining the claims raised in the complaint of the Public Commissioner, it found these rights while reaching the conclusion that Gramshi had made an insufficient declaration of assets. 

The leader of the team read, among other things, that the judge had made "attempts to prevent the full control of the property". Overall, the appeal found that Gramshi had made incorrect declarations and announced the change of the decision of the Independent Qualification Commission and his dismissal from office. 

Gramshi was confirmed in office on March 25, 2022. During two hearings on February 15 and March 24, he gave explanations mostly about the income from his father's commercial activity in the years 1992-1999, as well as about the income from his work and of family members in the USA, where he lived for more than a decade as an asylum seeker. Gramshi was positively evaluated for the cleanliness of the image and no problems were identified for professionalism. 

But the decision was not found to be justified by the International Monitoring Operation, which estimated that the correct assessment of all issues in the wealth criterion would lead to the dismissal of judge Gramshi. IMO requested that a complete financial analysis be performed for all years, from 2003 when the subject arrived in the USA and following, which was also submitted by the commissioner in appeal and during the review of the case in the Special Appeal Chamber.

Kastriot Gramshi started his career as a judge in 1999 in Shkodër and in 2004 he left office at his request. Before returning to Albania and resuming his career as a judge in 2014, he worked as a criminal law lecturer in the USA. Gramshi has been working at the Tirana District Court for eight years.
