Gërdec Case, Strasbourg Court Decides in Favour of Affected Families

After about 14 years since the tragic explosion in Gërdec and the initiation of a new trial for the former Minister of Defense at that time, the Strasbourg Court has made a decision in favour of the affected families. While it is pointed out that there were procedural violations during the process, the Court demands compensation of 12 thousand euros for Zamira and Feruzan Durdaj. 

"The respondent state must pay the applicants, within three months from the date on which the decision becomes final in accordance with Article 44 § 2 of the Convention, the following sums: jointly Zamira Durdaj and Feruzan Durdaj, 12,000 euros (twelve thousand euros), plus any tax that can be paid for non-pecuniary damage; to the remaining applicants, 10,000 (ten thousand euros) each, plus any tax that may be payable for non-pecuniary damage; jointly for all applicants, 8,000 (eight thousand euros) euros, plus any tax that may be charged to them, in respect of costs and expenses; from the expiration of the above-mentioned three months until repayment, simple interest will be paid on the above amounts at a rate equal to the marginal lending rate of the European Central Bank during the period of non-payment plus three percentage points", states the decision of Strasbourg. 

The people who sent the case to Strasbourg are Zamira Durdaj and Feruzan Durdaj, the parents of the deceased Erison Durdaj, Feruzan Durdaj, Roxens Durdaj, Alketa Hazizaj, Aishe Selami, Pashk Kaçi, Mirela Hazizaj, Miselda Zguri, Medi Gola, Rabie Gërdeci, Shaban Brahushi, Sabrie Picari, Dylbere Prini, Adelina Cani, Meltina Haka, Bege Aliu and Esmeralda Sefaj. 

"At the time of the explosion, Erison Durdaj, then seven years old, had passed by the facility together with his cousin, Roxens Durdaj. Erison Durdaj was seriously injured by the explosion and was transferred to a hospital in Italy as an emergency measure, where he died on April 3, 2008. Roxens Durdaj, then 11 years old, was seriously injured by the flames of the explosion. All thirteen applicants in application no. 46707/13, as well as the second applicant in request no. 46714/13 Alketa Hazizaj, were working in the facility and were seriously injured by the explosion', it is written in the decision.
