Man Sentenced with over 7 Year in Jail for Indecent Acts against Minor Niece

Fier Prosecution has concluded the investigations and took the citizen S.H. to court for the criminal offense of "Imoral Acts," as defined in Article 108/2 of the Criminal Code.

The investigations into criminal case No. 811, registered after a complaint filed at Lushnja Police Station on June 4, 2024, the Prosecutor's Office substantiated that the defendant, S.H., was engaged in unlawful and direct actions against his 11-year-old minor granddaughter, E.H., repeated at various times.

The defendant, S.H., repeatedly threatened the minor, stating that he would kill her if she spoke out. As a result, the prosecuting authority was informed of the criminal act by the Child Protection Unit and the psychologist from the minor's school, after noticing significant changes in her behavior.

The Prosecutor's Office concluded that the defendant’s actions, against his minor granddaughter, E.H., have violated her psychological and emotional integrity, causing psychosocial consequences such as fear of living alone in the apartment where she resides with her parents, insecurity about the future, and more. The source of these consequences stems from the harassment and indecent acts that the defendant, S.H., subjected her to.

Fier District Court, based on the prosecution’s request, rendered the following decision:

  1. The defendant, S.H., was found guilty of "Immoral Acts," as stipulated in Article 108/2 of the Criminal Code and sentenced to 7 years and 6 months in prison.
  2. Pursuant to Article 406 of the Criminal Procedure Code, the sentence is reduced by one-third, resulting in a final sentence of 5 years in prison for the defendant, S.H.
