Minister of Justice, Toni Gogu, said Saturday that a legal gap over the salaries of magistrates will be addressed Tuesday, during the first plenary session of the new parliamentary session.

Speaking to reporters, Gogu said the dispute was not about whether magistrates were seeking higher salaries or whether the government was unwilling to provide them, but rather about the lack of a legal basis for calculating magistrates’ salaries following a decision by Albania’s Constitutional Court.

“We have to say it clearly: We have reached this point because we lack the legal basis for the formula used to calculate magistrates’ salaries, which was annulled by the Constitutional Court. This gap must be filled where it belongs: in Parliament, through legislation,” Gogu said.

The minister said the issue is expected to be addressed as Parliament begins its new session, describing the legislative intervention as the necessary step to resolve the dispute.

“The solution is not for institutions to clash with one another. The solution is in the Parliament of Albania. My responsibility is to ensure that this happens quickly and properly, in compliance with the decision of the Constitutional Court and with full responsibility toward the state budget,” Gogu said.

Asked by Top Channel journalist Anila Hoxha about an instruction published by Albania’s Special Court Against Corruption and Organized Crime (GJKKO), which states that Parliament’s failure to act by July 31, 2026, cannot have a suspensive effect on the implementation of the Constitutional Court’s decision, Gogu said the government would have acted differently had the court itself established a legal salary formula.

“If the Constitutional Court’s decision, after the expiration of the legal deadline, had established the legal formula, the minister would have implemented it without any ambiguity,” Gogu said.

The minister was also asked what would happen to judges, prosecutors and judicial administration staff until Parliament intervenes.

“Salaries require legal authorization and a legal formula. These have been the government’s efforts, so that salaries are not delayed for even a single day,” Gogu said.
