Albania’s Constitutional Court Orders Review of Tirana Mayor’s Detention Appeal

Albania’s Constitutional Court has sent back to the Supreme Court the case concerning Tirana Mayor Erion Veliaj, ordering the country’s highest court to issue a decision on his appeal against the “arrest in prison” security measure.

The Constitutional Court ruling was approved by a 5-3 majority in favor of Veliaj.

According to the decision, the ruling was based on the jurisprudence of the United Colleges and on an opinion issued by the Venice Commission.

“The Court, by majority vote, decided the ‘partial acceptance of the request’; the ‘annulment of decision no. 00-2025-1153 (176), dated 08.07.2025, of the Criminal College of the Supreme Court, as incompatible with the Constitution of the Republic of Albania. The case is remanded to the Supreme Court for review,’” the decision stated.
