C. Court Abrogate Special Law on National Theatre: Demolition Was Illegal

The Constitutional Court has decided to abrogate the Special Law on the National Theatre suspending so the construction of a new one. At the same time, this Court also abrogated the last decision of the Council of Ministers in Albania to transfer the ownership of the National Theatre to the Tirana Municipality and also the decision of the last to demolish the old theatre.

According to this Court, the implementation of the urban project and the new building of the National Theater" is incompatible with the Constitution and international agreements. Same as the decision no. 377, dated 08.05.2020 of the Council of Ministers "On the transfer of ownership of the Municipality of Tirana, property no. 1/241, with the name" National Theater ", in cadastral zone 8150, Tirana" (DCM no. 377/2020).

"Court repeal decision no. 50, dated 14.05.2020 of the Municipal Council of Tirana, Municipality of Tirana, “On the approval of the demolition of the building of the“ National Theater ”, owned by the Municipality of Tirana, based on the Act - Expertise drafted by the Construction Institute on the evaluation of the building National Theater ”(VKB no. 50/2020), as incompatible with the Constitution," says the last statement of the Court made this Friday.

All the implementation of these acts until the entry into force of the final decision of the Constitutional Court will be suspended.
