Illegal Construction Inside a Hotel Seized by Saranda Prosecution; Details
The measure of “Preventive Seizure” was ordered at Saranda Prosecution’s request for the area measuring 22.9 m x 13.4 m x 3.5 m, built on the terrace of the existing building known as “Hotel Oasis”, a 6-story building in neighborhood no. 1, Sarandë Municipality, under the name of citizen Alqi Papa.
The investigations into criminal proceedings no. 116 of 2026, registered for the criminal offenses “Illegal construction for profit” and “Abuse of office”, as provided in articles 199/a/4 and 248 of the Crimnal Code, the examination of the works found on site—which consist of the building of the supporting metal structure, the installation of the roof and floor slab with corrugated metal and concrete layers, the division of interior spaces, as well as the completion of the façade and installation of windows—proved that a new functional construction volume was created over the existing building.
The construction works appear to have been built gradually, at least from before 12.05.2025 and continuing until 31.03.2026, the date on which, during an expert inspection, it was observed that the building had reached an advanced stage of completion, including the exterior façade and front windows.
Although the property is registered as land in the ownership certificate, based on the legalization decision, the existing building is classified as social-economic type (service), and as such, the works found are functionally related to this purpose, thus constituting elements of the criminal offense “Illegal construction for profit”, as stipulated in article 199/a/4 of the Penal Code, by citizen A.P., who is the owner of the building and administrator of the legal entity.
Based on the above and at the request of the prosecution, a preventive property seizure was ordered, as provided for in Article 274 of the Code of Criminal Procedure, for the construction area measuring 22.9 m x 13.4 m x 3.5 m, suspected to have been built without the permission of the competent authorities.
