Botanical Garden Remains Property of University; Court Decides

The Administrative Court has given the decision in favour of the University, regarding the Botanical Garden.

Thus, the DCM (Decision of the Council of Ministers) on the transfer of the Botanical Garden to the Municipality of Tirana was overturned.

The last decision of the Council of Ministers was for the transfer of ownership, to the Municipality of Tirana, of some immovable properties in the cadastral zone 3292 (Botanical Garden), and this seems to have worried the Faculty of Natural Sciences.

The Dean of the Faculty of Natural Sciences, Spiro Dushku announced that he recently held an extraordinary meeting in which he discussed this decision of the Council of Ministers, that he considers arbitrary and in flagrant contradiction with the DCM dated 15.03.1965 on the establishment of the Botanical Garden, the only research-teaching institution in the country in the area of flora, unique in its kind in the country and as such declared in 1995 as an institution of special importance.

"The decision to transfer it into ownership and administration of the Municipality not only seriously violates the autonomy, academic freedom and the Law on Higher Education, but would also make impossible the function of this institution, the product of dedicated work of more than 60 years of generations of professors and students of the Faculty of Natural Sciences.

We say once again that we have been and are open to any cooperation aimed at supporting and developing this institution with unique national values, in respect of its purpose, mission and functioning. In this context, we welcome the plans and investments of the Municipality of Tirana, but always agreed and without compromising the function and mission of the Botanical Garden.

The final session for the judicial process, supported by the Faculty of Natural Sciences, has just ended in the presence of professors and students, becoming the property of the University. It has been a long process, until we have completed this decision. I want to thank the judge, who was professional in his duty. The decision was in favor of the public. The Municipality of Tirana has the right to appeal, but we will pursue this issue legally until the end. We will walk as the law gives us the right, that property, which cannot be violated ", declared Drushku.
