CC Reinstates Belinda Balluku as Deputy Prime Minister and Minister of Infrastructure

The Constitutional Court has reinstated Belinda Balluku to her duties as Deputy Prime Minister and Minister of Infrastructure and Energy, overturning the suspension previously imposed by the Special Court Against Corruption and Organized Crime (GJKKO). The decision follows the Court’s acceptance for review of the appeal submitted by Prime Minister Edi Rama.

The ruling was reached with 5 votes in favor and 3 against.

In its official statement, the Constitutional Court confirmed that on 12 December 2025, the Meeting of Judges conducted a preliminary review of case no. 30(K)2025, filed on 21 November 2025, with the Prime Minister as petitioner. The request sought resolution of a competence dispute between the Prime Minister/Council of Ministers and the Special Court, regarding the suspension of a member of the Cabinet.

The Prime Minister argued that the GJKKO’s decisions—no. 118 (19.11.2025) and no. 120 (22.11.2025)—which ordered and upheld Balluku’s suspension, violated constitutional guarantees of ministerial immunity, the separation of powers, and the exclusive constitutional authority over ministerial appointments.

With this ruling, Belinda Balluku immediately resumes her duties as Deputy Prime Minister and Minister of Infrastructure and Energy pending the final outcome of the constitutional review.

With majority vote, the Court has suspended the execution of the GJKKO decisions no. 118 and no. 120, specifically the parts enforcing Balluku’s suspension from office. The suspension will remain in force until the Court issues a final judgment. The decision will be published in the Official Gazette.

With majority vote, the case will proceed to a public plenary session, citing high public interest. The Court will also summon the Special Anti-Corruption Prosecution (SPAK), the Special Court, the Albanian Parliament, and the President of the Republic as interested parties.
