Lifer's Sentence Reduced, Case on Accused Judges Dismissed
Special Prosecution against Organized Crime and Corruption's (SPAK) suspicions that the judges who accepted Dritan Dajti's request for a shortened trial could have been corrupted were finally dismissed on Monday, October 26, when Special Court Judge Miliana Muça accepted the indictment request for termination of investigations.
The Head of the Special Court against Organized Crime and Corruption (GJKKO), Sander Simoni, told BIRN that a hearing was held on Monday at 14:00, where the Prosecution requested the termination of the investigation against Judges Skënder Damini, Aleks Nikolli and Petrit Aliaj.
"The court has returned the case twice for conducting other investigations. The Prosecution carried out the investigative actions requested by the Court, where at the end of them, the Prosecution again concluded that there is no evidence to attribute charges and requested the dismissal of the case against them", explained Judge Simoni.
Dritan Dajti was sentenced to life imprisonment by the Serious Crimes Court for the murder of four police officers and was in the cell since the 2009 massacre. However, on February 8, 2019, an acting judicial body at the Appellate Court decided to accept the shortened trial and lowered his sentence to 25 years of imprisonment.
Although the case was adjudicated in court for 10 years, the three judges Skënder Damini, Aleks Nikolli and Petrit Aliaj in the majority, decided to accept Dajti's request for a shortened trial, which led to a reduction of 1/3 of the sentence. The other two judges who voted against were Fuat Vjerdha and Lindita Hoxha.
