Nine Dismissed Magistrates Seek Return to Albania’s Justice System

At least nine former judges and prosecutors dismissed through Albania’s vetting process have asked the Constitutional Court to review decisions that removed them from the justice system, following the end of the Special Appellate College (KPA) in June 2026.

Four of the former magistrates have European Court of Human Rights rulings that identified violations in their vetting proceedings and, in some cases, called for their cases to be reconsidered.

The group includes former Court of Appeal judge Ervin Metalla, former Durrës Appeal Prosecutor Ferdinand Elezi, former prosecutor Gentjan Osmani and former Puka Court chief judge Izet Kadana.

Other former magistrates seeking review include Bledar Avdullai, Alltun Çela, Luan Hasneziri and former Tirana chief prosecutor Elizabeta Imeraj.

The Constitutional Court inherited the KPA’s powers after the vetting appeals body completed its mandate. Under previous KPA practice, requests to reopen cases were generally rejected unless supported by a Strasbourg ruling calling for reconsideration.

The Constitutional Court is now expected to determine whether the new requests meet the legal criteria for reviewing final vetting decisions.

Meanwhile, the Court is also considering a separate request from SPAK concerning prosecutor Elona Alvora, whose vetting case previously resulted in a one-year training measure at the Magistrates’ School. Her future in the justice system is expected to depend on the outcome of the new proceedings.
